Requirements for Riders:
Muskegon SandBox Inc.is committed to conducting its practice and racing programs
and activities in a safe manner and holds the safety of participants in high
regard. Muskegon SandBox Inc.continually strives to reduce such risks and insists
that all participants follow safety rules and instructions that are designed
to protect the participant's safety. However, participants and parents/guardians
of minors registering for this program must recognize that there is an inherent
risk of injury when choosing to participate in motocross, and practice activities.
Motorcycle/Snowmobile racing, riding, or dirt racing, requires different skills
and techniques than normal. Race bikes have a different tire tread and design
and their engines supply more power. They are lighter weight, with heavy-duty
suspension systems and wider handle bars for greater control. The engines are
designed for faster than normal speeds over rough terrain. As in all sports,
experience plays a major role in reducing accidents. Begin gradually on gentle
terrain before attempting more difficult jumps and higher speeds. And, before
attempting a challenging race or practice, travel your intended course slowly
at first. New hazards, such as fallen riders, muddy conditions, loose loamy
sand, may be different than the last time you were on the track. All-terrain
vehicles (ATVs), Snowmobile/Motocross race bikes (YZ's, KX's, RM's, CR's, etc.)
are dangerous if not operated carefully, so you should take special care to
prevent injury. Knowing all you can about your ATV Snowmobile/Motocross bike
and about the rules and regulations controlling its use will help you prepare
for safe and enjoyable racing and practicing. Read your manufactures safety
manual. Remember that ATVs, Snowmobile/motocross bikes are intended for off-highway
use, and racing. Do not ride your ATV's, Snowmobile/race bikes in the pits with
a racing attitude.
You are solely responsible for determining if you or your minor child/ward is
physically fit and/or adequately skilled for the activities contemplated by
this agreement. It is always advisable, especially if the participant is pregnant,
disabled in any way or recently suffered an illness, injury or impairment, to
consult a physician before undertaking any physical activity.
WARNING OF RISK
Motorcycle/Snowmobile and ATV racing or dirt riding, is an activity, which challenges
and engages the physical, mental and emotional resources of each user. However,
despite careful and proper preparation, instruction, medical advice, conditioning
and equipment, there is still a risk of serious injury, including but not limited
to death, head/brain injury and cervical spine injury (including quadriplegia).
Understandably, not all hazards and dangers can be foreseen. Contributing factors
to such risks include unfamiliarity with the track failing to wear protective
equipment; losing control of the bike; inexperienced riders; riding too fast
for race track conditions; adverse weather conditions; excessive speed; poor
knowledge of the capabilities of the ATV,Snowmobile or race bike; poor understanding
of safety rules, laws, and regulations; carrying passengers; hitting visible
or hidden fixed objects; unstable suspension; impaired judgment and skill due
to alcohol consumption; mechanical malfunctions; striking an irregularity in
the race track surface; losing balance; trying to perform stunts; inadequate
or defective equipment; failure in supervision or instruction; attempting a
maneuver beyond one’s skill level, and all other circumstances inherent
to racing and dirt riding. In this regard, it must be recognized that it is
impossible for Muskegon SandBox Inc.to guarantee absolute safety.
WAIVER AND RELEASE OF ALL CLAIMS AND ASSUMPTION OF RISK
Please read this form carefully and be aware that in signing up and participating
in this activity, you will be expressly assuming the risk and legal liability
and waiving and releasing all claims for injuries, damages or loss which you
or your minor child/ward might sustain as a result of participating in any and
all activities connected with and associated with this activity.
I recognize and acknowledge that there are certain risks of physical injury
to participants in this activity, and I voluntarily agree to assume the full
risk of any injuries, damages or loss, regardless of severity, that my minor
child/ward or I may sustain as a result of participating in any and all activities
connected with or associated with racing and/or practicing or dirt bike riding.
I further agree to waive and relinquish all claims I or my minor child/ward
may have (or accrue to me or my child/ward) as a result of participating in
this program against Muskegon SandBox Inc, including its officials, agents,
volunteers and employees. I do hereby fully release and forever discharge Muskegon
SandBox Inc. from any and all claims for injuries, damages or loss that my minor
child/ward or I may have or which may accrue to me or my minor child/ward and
arising out of, connected with, or in any way associated with this activity.
PARTICIPATION WILL BE DENIED IF The signature of adult participant or parent/guardian, and date are not on this waiver.
